Tour Indemnity

Last updated:

This indemnity applies to every tour with Cape Hikes and Tours, operated by Geoff Tennant, registered tourist guide WC14954. That includes guided hikes, road and city tours, wine tours, cable car and garden walks, bespoke and multi-day tours. The person making the booking accepts it on behalf of every guest named in the booking, and confirms that each guest has read it and agrees to it. A parent or legal guardian accepts it on behalf of any guest under 18.

1. Risks

I understand that every tour carries risks that cannot be fully removed, even with a careful guide.

These can cause injury, illness or, in rare cases, death.

2. Health and fitness

I confirm that I and every guest in my booking are in good health and fit enough for the tour chosen, including the grade of any hike. I have told Cape Hikes and Tours about any medical condition, injury, medication, allergy, dietary need, pregnancy, mobility limit or fear of heights that could affect any guest. I will carry any medication a guest needs, such as an asthma pump or allergy pen.

3. Following the guide

I agree that every guest will follow the guide's instructions, stay with the group, wear a seatbelt in the vehicle, and wear suitable shoes and clothing. The guide may change the route or itinerary, turn back or end the tour if he believes it is unsafe to continue, and his decision is final. A guest who ignores safety instructions may be asked to leave the tour, with no refund.

4. Alcohol on wine tours

Wine tastings are for guests aged 18 and over. Guests drink responsibly and at their own risk. The guide or a wine estate may refuse further tastings to anyone who appears intoxicated, and Cape Hikes and Tours is not responsible for the conduct of guests who have been drinking.

5. Third-party services

Cable cars, wine estates, restaurants, parks and other attractions are run by independent businesses. Cape Hikes and Tours is not responsible for their services, closures, delays or the actions of their staff.

6. Medical treatment

If a guest is injured or falls ill, I agree that the guide may give first aid and call emergency services, including Wilderness Search and Rescue and an ambulance or helicopter. Any medical, rescue or transport costs are the guest's own responsibility. Travel insurance that covers the activities booked, medical treatment and evacuation is strongly recommended.

7. Indemnity

To the extent permitted by South African law, I, on behalf of myself and every guest in my booking, take part voluntarily and at our own risk. We release and indemnify Cape Hikes and Tours, Geoff Tennant and anyone working with them against any claim for injury, illness, death, or loss of or damage to property arising from the tour, except where caused by their gross negligence. This includes claims by our dependants, heirs or estates.

8. Personal belongings

Guests are responsible for their own belongings, cameras and phones during the tour, including anything left in the vehicle.

9. Agreement

By completing a booking for any tour, the person booking confirms the full names of all guests and accepts this indemnity on behalf of each of them. The guide may ask each guest to confirm their agreement at the start of the tour.

This indemnity is governed by the laws of South Africa and should be read with the Booking Terms.
